General Terms and Conditions (GTC)
1. Scope
1.1 These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB) via the online shop of ZenSaku Studio, owner Ina Deeken, Drimbornweg 3, 53909 Zülpich (hereinafter referred to as "provider" or "we").

2. Conclusion of the contract

3.1 All prices quoted are Final prices excluding VAT according to §19 UStG (small business regulation).
3.2 For orders outside the EU, additional charges may apply. Import taxes or duties costs that are to be borne by the buyer.

4. Shipping & Delivery Conditions
4.1 Delivery is worldwide. Shipping costs vary depending on the delivery area. and are displayed during the checkout process before the order is completed.
4.2 Delivery will take place within the period specified by Printing partner Gelato Predetermined delivery times. These vary depending on the destination country.
4.3 The supplier is not responsible for delays caused by the shipping service provider or customs clearance.
4.4 If an item is unavailable, the customer will be informed immediately and can choose between a replacement delivery or a refund.
5. Right of withdrawal & returns
5.1 Consumers have a legal right Right of withdrawal of 14 days. ZenSaku Studio grants a right of withdrawal of 30 days.
5.2 If a product is delivered defective or faulty, the customer must report this within 7 days after receipt Please report via email or the contact form.
6. Return shipping costs & refunds
6.1 The The customer bears the costs of return shipping , unless the goods were damaged or defective.
6.2 Refunds will be processed within 14 days after receipt of the returned goods and will be refunded to the original payment method.
7. Retention of title

8. Warranty & Liability
8.1 The statutory warranty applies. 2 years according to § 437 BGB.
8.2 The provider is liable not liable for damage caused by improper use of the products.
8.3 Liability is unlimited in cases of intent, gross negligence, and for damages resulting from injury to life, body, or health. In cases of slight negligence, liability is limited to breaches of essential contractual obligations (cardinal obligations), and even then, only to foreseeable damages typical for this type of contract.

10. Applicable Law & Jurisdiction

12. Scope of application for international orders
12.1 Customers from the USA and Canada They are themselves responsible for ensuring that the import of the ordered goods is permitted in their country.
12.2 Additional Customs and import duties (such as Sales Tax in the USA or GST/HST in Canada) is borne by the buyer.
13. Disclaimer for the US market
13.1 The provider assumes No liability is accepted for damages or consequential damages arising from the use of the products, unless they are due to gross negligence or intent to be attributed to.
13.2 To the extent permitted by law, liability for indirect damages, lost profits or consequential damages excluded.
13.3 The buyer acknowledges that Print-on-demand products are personalized and therefore can only be returned in the case of production defects.
14. Returns & Cancellations for USA & Canada
14.1 For customers from the USA and Canada There is no statutory right of withdrawal , but ZenSaku Studio also grants a 30-day right of withdrawal .
14.2 If an order is delivered faulty or damaged, the buyer must report the damage within 7 days after receipt Please report via email or the contact form.
15. Data Protection & Data Usage (USA & Canada)
15.1 The provider processes personal data in accordance with the Privacy Policy and applicable data protection laws, including the GDPR (Europe), CCPA (California) and PIPEDA (Canada) .
15.2 Customers from California have the right to a Deletion or access to their stored data to require (CCPA).
15.3 Customers from Canada have the right to access their stored data to view or correct (PIPEDA).
